Under Section 27(b) of the Act, the CCI can levy fines up to 10% of the average turnover from the last three years for abuse of dominant position and anti-competitive agreements. However, Section 46 permits the imposition of lesser penalties, guided by the Competition Commission of India (Lesser Penalty) Regulations, 2009.
