The Companies Act, 2013 has been assented to by the President of India on 29.08.2013 and published in the Official Gazette on 30.08.2013 which empowers the Central Government to bring into force various sections from such date(s) as may be notified. Accordingly, 98 Sections of the Companies Act, 2013 have been notified on 12.09.2013. Giving this information in written reply to a question in the Lok Sabha, Minister of Corporate Affairs, Shri Sachin Pilot, said that the rest of the provisions, including section 455 of the Companies Act, 2013 dealing with dormant company is yet to be notified as it prescribes Rules also to be notified while notifying the provisions of the Companies Act, 2013. Thus extensive Consultations with stakeholders, public at large and other Regulators are being carried out.
Implementation of Companies Act: many sections notified while provisions needing rules, including dormant company regime, remain pending consultations. Implementation of the Companies Act proceeds by selective notification of sections while provisions dependent on subsidiary Rules, such as the dormant company concept, remain uncommenced pending formulation of Rules and coordinated stakeholder and regulator consultations to ensure aligned operationalisation.Press 'Enter' after typing page number.
