Vivad se Vishwas settlement does not resolve a separate reassessment dispute, requiring appellate adjudication on merits.
Settlement under the Vivad se Vishwas Scheme for an assessment completed under section 143(3) does not settle a separate reassessment made under section 147 read with section 144B. Dismissal of an appeal on the assumption that the reassessment dispute was settled is unsustainable where the scheme settlement concerns only the separate regular assessment. The contested reassessment issues require adjudication on their merits by the appellate authority.

Section 50C valuation requires material land disadvantages to be considered before adopting a valuation for capital gains computation.
Section 50C requires the prescribed stamp-duty value to be adopted for capital-gains computation where declared consideration is lower, subject to the valuation mechanism under Section 50C(2). Land valuation must adequately reflect material factors affecting value, including road and transport access, location, size, timing, amenities and future potential. Where those factors are not properly considered, the valuation may be excessive. On the stated facts, the Section 50C addition was restricted, with the determination confined to the particular assessment circumstances rather than treated as a general precedent.

Customs arrangements for 24x7 working and extended functioning of assessment groups, docks and laboratory facilities are modified by deleting the words "in China" from paragraph 2. The change removes a geographic qualification from that provision. All other provisions, operational arrangements and requirements relating to the extended customs working framework remain unchanged.
Land valuation adjustments for transmission lines and poor access require recomputation of deemed income addition at a reduced uniform rate.
Valuation for an addition arising from the difference between purchase consideration and property value under Section 56(2)(vii)(b) must reflect material adverse features affecting the land. High-voltage transmission lines and electricity towers rendered substantial portions unusable, while lack of direct highway access and monsoon-season approach further reduced value. Comparable sale instances must be shown to be adjoining or otherwise sufficiently comparable. A uniform valuation of Rs. 510 per square metre was excessive in these circumstances. Both land parcels should be valued uniformly at Rs. 450 per square metre, with the addition recomputed accordingly.

Section 143(2) notice timing in block assessment raises statutory applicability and natural justice requirements under Chapter XIV-B.
Application of the notice requirement under section 143(2) to block assessments under Chapter XIV-B involves the statutory qualification "so far as may be", the proviso prescribing the notice time limit, and compliance with principles of natural justice, including audi alteram partem. The key legal focus is whether and how the regular assessment notice procedure and its temporal limits operate within the special block-assessment framework.
Notice timing in block assessments tests application of regular assessment safeguards and audi alteram partem requirements.
Notice under section 143(2) in a block assessment under Chapter XIV-B raises the extent to which regular assessment procedures apply so far as may be. The key issues concern whether the proviso prescribing the notice time limit governs such block assessments and whether timely notice is required to satisfy audi alteram partem requirements.
Co-operative bank deposit interest qualifies for Section 80P deduction when earned by a co-operative society.
Section 80P(2)(d) permits a co-operative society to deduct interest income derived from investments or deposits with another co-operative society. Section 80P(4) prevents a co-operative bank from claiming deduction under Section 80P but does not alter its status as a co-operative society registered under applicable State co-operative societies law. Interest received by a co-operative society on deposits with co-operative banks therefore qualifies for deduction under Section 80P(2)(d).

Late filing charges for delayed Bills of Entry may be waived by the designated proper officer. A separate ICES ACL-menu function de-links the waiver from Bill of Entry assessment. Before duty payment, an officer with the ACL role may process the waiver after obtaining the required approval, without recalling the Bill of Entry. This avoids reassessment of RMS-facilitated Bills of Entry solely for reduction or removal of late filing charges.

Co-operative bank interest qualifies for Section 80P deduction when the bank remains a co-operative society.
Section 80P(2)(d) allows a co-operative society to deduct interest derived from investments with another co-operative society. A co-operative bank continues to fall within the definition of a co-operative society under Section 2(19), even though Section 80P(4) excludes the bank itself from claiming a deduction under Section 80P. Where conflicting non-jurisdictional High Court decisions exist, the interpretation favourable to the assessee applies. Interest income from bank investments was therefore treated as eligible for deduction under Section 80P(2)(a)(i) or Section 80P(2)(d).
