Circular No. 152/8/2021-GST Dated:- 5-1-2022 Jharkhand SGST Dated:- 5-1-2022 Jharkhand SGST
Composite works contracts supplied to a Government Entity qualify for the concessional GST rate only where the original work is predominantly intended for non-commercial use. The exclusion of public-authority activities from the term business applies only to the Central Government, State Government and local authorities, not to Governmental Authorities or Government Entities. Tourism ropeway construction is treated as commercial in nature and is not covered by concessional entries for roads, bridges, terminals or railways. Such turnkey ropeway works-contract services attract GST at 18% under entry 3(xii).

Circular No. PUBLIC NOTICE NO. 51/2023-24 Dated:- 26-9-2023 Trade Notice Dated:- 26-9-2023 Trade Not...
Faceless Assessment is to be expedited through complete, legible, and properly linked supporting documents uploaded on e-Sanchit when filing the Bill of Entry. Importers and customs brokers should upload technical and valuation records, compliance certificates, registrations, permits, and documents supporting duty-exemption or preferential-duty claims, where applicable. Queries must receive specific replies. Provisional assessment filings should state and document the reasons for provisionality. Additional documents may be required according to the imported goods and the requirements of assessment.

Accreditation and registration services supplied to institutions or professionals to authorise their services remain taxable at the applicable rate.

Ex Parte Appellate Orders: Appeals require fresh merits adjudication after the assessee receives a reasonable opportunity of hearing.
Ex parte disposal of an appeal by the first appellate authority required restoration for fresh adjudication on merits. A reasonable opportunity of hearing had to be afforded to the assessee before reconsideration, as restoration was necessary in the interests of justice. The appeal was remitted to the first appellate authority for determination on merits after providing that opportunity.

Notification No. 26/2026-Customs Dated:- 24-10-2026 Anti Dumping Duty
Anti-dumping duty applies for five years to Titanium Dioxide imports originating in or exported from China PR within the identified tariff items. Producer-specific rates range from 460 to 681 USD per metric tonne; a specified higher rate applies to China-origin goods routed through other countries by non-enumerated producers and to goods of other origins exported from China. Individual rates require a valid certified commercial invoice identifying the manufacturer, volume and origin; otherwise, the applicable all-other-producers rate applies. Specified food, pharmaceutical, skin-care, textile, fibre, de cor-paper and nano or ultrafine uses fall outside the product scope.

Circular No. PUBLIC NOTICE No. 47/2024 Dated:- 13-6-2024 Trade Notice Dated:- 13-6-2024 Trade Notice
Export General Manifest compliance requires delivery of the manifest before a conveyance carrying export goods departs from the Customs station. EGM errors or incorrect filing may delay post-export benefits and incentives. The monthly process identifies EGM errors and Shipping Bills with pending EGM filing. Exporters and Customs Brokers should arrange through concerned airlines for correction of errors or filing of pending EGMs, as applicable.

Circular No. 222/16/2024-GST Dated:- 14-10-2025 Jharkhand SGST Dated:- 14-10-2025 Jharkhand SGST
Spectrum allocation services supplied for a right to use spectrum are subject to reverse charge in the hands of the telecom operator. Deferred instalment arrangements constitute continuous supply of services where spectrum usage extends beyond three months with periodic payment obligations. The Frequency Assignment Letter is a bid-acceptance and allotment instrument, not a document issued in lieu of an invoice. GST is payable on an upfront amount when payment is made or becomes due, whichever is earlier; for deferred instalments, liability arises separately when each instalment is made or becomes due, whichever is earlier.

Notification No. 25/2026-Customs Dated:- 24-10-2026 Anti Dumping Duty
Rescission of the anti-dumping duty notification withdraws the earlier duty framework for titanium dioxide originating in or exported from China PR. The withdrawal is subject to a savings provision preserving anything done, or omitted to be done, before the rescission. Earlier actions, obligations, and omissions under the rescinded framework remain unaffected to that extent.

Penny-stock additions require assessee-specific evidence; unsupported share-sale additions were deleted, while undisclosed ITS data required fresh consideration.
Penny-stock additions require an objective assessment of assessee-specific evidence; documented exchange-traded purchases and sales, supported by contract notes and bank records, cannot be rejected merely on a general investigation report without defects in the transactions or material linking the assessee to price manipulation. The sale-proceeds and estimated-commission additions were therefore deleted. Share-profit additions founded on ITS data require disclosure of the underlying purchase and sale details to afford an effective opportunity to respond. The ITS-based addition required fresh adjudication after that disclosure, without a merits finding.

Unexplained expenditure additions require disproved purchases or sales; supplier non-traceability and cancelled GST registration alone are insufficient.
Section 69C cannot support an addition of the entire purchase amount merely because a supplier is untraceable or its GST registration has been cancelled. Recorded purchases supported by purchase documentation, stock records and banking evidence, together with undisputed corresponding sales, remain material where the books have not been rejected under section 145(3). Without evidence disproving the purchases or related sales, the purchases cannot be treated as wholly bogus; the full addition was unsustainable and deleted.

Explained Cash Deposits: Banking trail, provident-fund loan, withdrawals and salary savings supported deletion of unexplained cash-credit addition.
Cash deposits supported by bank records tracing housing-loan receipts and withdrawals, provident-fund borrowing, regular cash withdrawals, and accumulated salary savings were satisfactorily explained and could not be added as unexplained cash credits. Savings retained by a salaried taxpayer were not inherently inconsistent with ordinary human probabilities. Where the explanation included interest-free loans repaid by relatives, absence of enquiry or contrary evidence meant that the explanation was not disproved, supporting deletion of the addition.

Territorial jurisdiction for trials of offences punishable under the Prevention of Money-laundering Act is expanded by adding specified judicial forums and their district coverage in Karnataka. The XLIX Additional City Civil and Sessions Judge, Bengaluru, will cover Bengaluru and specified surrounding and southern districts. Principal and additional district judges at Dharwad will cover designated northern districts, with the additional judge also covering Davanagere. Principal and additional district judges at Kalaburagi will cover specified north-eastern districts. Principal and additional district judges at Mangaluru will cover Dakshina Kannada, Udupi, Shivamogga, Chikkamagaluru and Kodagu-Madikeri districts.

Circular No. 225/19/2024-GST Dated:- 14-10-2025 Jharkhand SGST Dated:- 14-10-2025 Jharkhand SGST
Corporate guarantee services supplied to related recipients remain taxable, with valuation based on the amount guaranteed rather than actual loan disbursement. Rule 28(2) prescribes a value of one per cent per annum of the guaranteed amount or actual consideration, whichever is higher, with proportionate treatment for co-guarantors and shorter guarantee periods. Domestic guarantees operate under forward charge, while guarantees supplied by foreign related entities to Indian recipients are subject to reverse charge. Invoice value is accepted where the recipient has full input tax credit, and the special valuation rule excludes guarantees supplied to recipients outside India.

Circular No. Public Notice No. 6/2026 Dated:- 17-3-2026 Trade Notice Dated:- 17-3-2026 Trade Notice
Back to Town permission is relaxed for stranded export containers and shipping bills where the Export General Manifest has not been filed. Exporters or authorised Customs Brokers must apply to the concerned Assistant or Deputy Commissioner (Export). Customs officers must verify container seals against shipping bill and stuffing records; where seals are intact, physical examination is waived. BTT-related fees and penalties are also waived for the specified shipments until further orders or normalisation of shipping operations.

Membership of the SEEPZ SEZ Authority is amended by substituting the entries at serial numbers 5 and 6 in the earlier notification. The revised entries replace the previously named members with managing directors of different entities operating in the SEEPZ SEZ. This changes the persons occupying those membership positions and updates the Authority's composition through the revised membership list.

Loan acceptance restrictions do not attract penalty where receipts occur through prescribed banking channels, not cash.
Restrictions on accepting loans or deposits outside prescribed banking modes do not apply where amounts are received through account-payee cheques, NEFT or RTGS rather than cash. An audit-report entry describing non-compliant loan receipts was corrected because it recorded the maximum outstanding loan balance, not loans received during the year. Confirmations and bank statements substantiating banking-channel receipts established no breach of Section 269SS; consequently, penalty under Section 271D was unsustainable.

Entries 5 and 6 of the notification concerning Falta SEZ are substituted. The listed enterprise representatives are replaced by the Managing Director of Patton International Limited and the whole-time Director of Cheviot Company Limited. The amendment thereby updates the designated representatives recorded for those entries under the Special Economic Zones Act, 2005.
