Dear Sir, We are a company (XYZ). One of our venders (ABC) has supply goods and as per terms ABC will pay the cost of transportation and later claim reimbursement from XYX. Tax on freight Rs. 1,275 TOTAL Rs. 10,51,275 I want to know can we claim the credit of above said service tax on freight. Pls note that the service tax registration of ABC is clearly printed on the invoice raised by him. Kindly check and clarify. Thanks & regards, Anshul.
Can XYZ Claim Service Tax Credit on Freight Costs Under Rule 2(l) of Cenvat Credit Rules, 2004? A company (XYZ) queries whether it can claim credit for service tax on freight paid to a vendor (ABC), who supplies goods and includes transportation costs and service tax in the invoice. ABC's service tax registration is printed on the invoice. A respondent, Surender, states that ABC can avail Cenvat Credit if conditions of Rule 2(l) of the Cenvat Credit Rules, 2004 are met. Another respondent, Preeti Aggarwal, explains that XYZ can claim the service tax as input tax if it relates to services for which XYZ pays service tax; otherwise, it cannot be claimed. (AI Summary)
