Company Expands to Manufacturing in Mumbai; Seeks Clarification on ROC Notification Under Section 149, Companies Act 1956. A trading company in Delhi has expanded by opening a manufacturing unit in Mumbai. The company seeks clarification on whether it is mandatory to inform the Registrar of Companies (ROC) about this new business location, given that their Memorandum of Association (MOA) already states their business nature as both trading and manufacturing. A respondent advises referring to Section 149 of the Companies Act, 1956, which imposes certain restrictions on the commencement of business but does not restrict starting a new manufacturing unit.
