Penalty of SIMS (Steel Import Monitoring System)

JIGNESH SITAPARA

Dear Experts,

My container will be arrival as on 10th August 2025.  But as on today I had no apply of SIMS certificate. Now, how much penalty in this issue ?

Late SIMS application may attract customs penalty, delayed clearance and risk to IEC; apply immediately. Failure to file a Steel Import Monitoring System (SIMS) application within the required 2-5 day pre-arrival window (policy effective 5 August 2025) constitutes non-compliance. Consequences include customs penalties for late submission, potential cargo clearance delays with demurrage, exposure to a show-cause notice, and risk to the importer's IEC; immediate late filing and consultation with a Customs House Agent are advised. Your container arrived on 10th August 2025, but as of 3rd September 2025, you have not applied for the SIMS (Steel Import Monitoring System) certificate. This is a clear non-compliance.

As per recent policy (effective from 5 August 2025), the SIMS application must be filed 2–5 days before the arrival of the consignment, depending on the country of origin. You missed this deadline completely.

In similar past cases, such as Cummins India Ltd, customs imposed a penalty of Rs. 50,000 and a redemption fine of ?1,00,000 for late submission of the SIMS certificate.

You are likely to face a similar penalty. Additionally, customs may delay clearance, and demurrage charges could apply. Theres also a risk to your IEC code if non-compliance continues.

Apply for the SIMS certificate immediately, even if late. Consult your CHA (Customs House Agent) for next steps and be prepared to respond to a show-cause notice from customs.
