Penalty of SIMS (Steel Import Monitoring System)

JIGNESH SITAPARA

Dear Experts,

My container will be arrival as on 10th August 2025.  But as on today I had no apply of SIMS certificate. Now, how much penalty in this issue ?

Late SIMS filing for container arriving 10 Aug 2025 violates SIMS rule effective 5 Aug 2025; expect penalties and delays Container arrival occurred 10 August 2025 but SIMS application was not filed; policy effective 5 August 2025 requires SIMS filing 2-5 days before arrival based on origin, so this is non-compliance. Likely consequences include monetary penalties (past cases imposed about ?50,000 plus a redemption fine around ?100,000), delayed customs clearance, demurrage charges, and potential risk to the importer's IEC if non-compliance persists. Immediate steps: file the SIMS application late, consult your CHA, and prepare to respond to a possible show-cause notice from customs. (AI Summary)

Your container arrived on 10th August 2025, but as of 3rd September 2025, you have not applied for the SIMS (Steel Import Monitoring System) certificate. This is a clear non-compliance.

As per recent policy (effective from 5 August 2025), the SIMS application must be filed 2–5 days before the arrival of the consignment, depending on the country of origin. You missed this deadline completely.

In similar past cases, such as Cummins India Ltd, customs imposed a penalty of Rs. 50,000 and a redemption fine of ?1,00,000 for late submission of the SIMS certificate.

You are likely to face a similar penalty. Additionally, customs may delay clearance, and demurrage charges could apply. Theres also a risk to your IEC code if non-compliance continues.

Apply for the SIMS certificate immediately, even if late. Consult your CHA (Customs House Agent) for next steps and be prepared to respond to a show-cause notice from customs.
