Can a company sell land after removal of its name from Register under section 248 of the companies act 2013 so as to transfer clear title to the buyer

Sanjeev Agrawal

Can a company sell land after removal of its name from Register under section 248 of the Companies Act 2013 so as to transfer clear title to the buyer.

Struck-off company property transfer requires restoration before land sale can convey clear title to the buyer. A company whose name has been removed from the register under section 248 of the Companies Act, 2013 is treated as a defunct company. The discussion states that such a company cannot sell land so as to convey clear title to a buyer while struck off, and that its name must first be restored before any petition or property transaction can be maintained in the company's name.
