Personal Hearing

Personal hearing rights: missed hearings may permit request for fresh opportunity or appeal to appellate authority on natural justice grounds.
Parties who miss a personal hearing may request an additional opportunity; authorities generally allow up to three adjournments and are liberal in granting rehearings. Ex parte decisions made after missed hearings are often remanded to secure compliance with natural justice. Adjudicating officers lack power to review their own final orders; the practical remedy is to appeal to the next forum to seek remand for fresh hearing on grounds of denial of hearing. (AI Summary)

Dear Experts,

we have missed the Personal Hearing date and not even given postponment letter. This happened in the Jt.Commissioner level. However, dept. makes this issue one side. Can i appeal the same in the next level?.

Kindly provide your valuable suggestions.

Thanking You

Srinivas
