Government Accepts Recommendation: Secure Title Deeds Post-Attachment and Expedite Auctions u/r 59 to Avoid Delays.
The Public Accounts Committee recommended that the Income-tax Department should secure title deeds for immovable properties after attachment to prevent complications. The government has accepted this recommendation, urging efforts to obtain these deeds from the assessee, especially when recovery stays or installment grants are requested. Additionally, the Committee observed that auctions of attached properties often faced delays due to insufficient bids. Rule 59 of the Income-tax Act allows government participation in subsequent auctions to expedite property disposal. Assessing Officers are encouraged to engage in these auctions actively. These instructions should be communicated to all relevant officers.
