of <h1>Private bonded warehouse licenses may be denied for serious past violations under Section 58 of the Customs Act, 1962</h1> Applications for private bonded warehouse licenses may be granted subject to examination of past violations by the applicant. The Customs Commissioner must assess whether violations are serious or technical. If violations are serious and indicate deliberate misconduct, the grant of a license under section 58 of the Customs Act, 1962 may be denied, even if such violations fall outside the five-year period specified in the earlier circular. This approach allows discretion beyond the strict five-year timeframe to prevent licensing parties with serious past infractions.
