India's Private Bonded Warehouses: Setup Guidelines and Import Regulations Under Customs Act, Section 58.
The circular addresses the establishment and operation of Private Bonded Warehouses for imports in India. Applications for setting up such warehouses must be submitted to the Assistant Commissioner of Customs under Section 58 of the Customs Act, 1962. These warehouses can import all goods except prohibited items, arms, ammunition, hazardous waste, and chemicals. Goods in the Negative List of Imports can be warehoused without a license but require one for clearance into the domestic market. Goods can be cleared for home consumption with applicable customs duties or against specific licenses, such as for hotels and restaurants. Advance License holders can clear goods duty-free, and no additional endorsements are needed for licenses valid for imports.
