DGFT Clarifies Advance Authorizations for SCOMET Exports: Get Authorization Before License, Pay Duty if License Denied in 4 Months.
The circular from the Directorate General of Foreign Trade clarifies the procedure for issuing Advance Authorizations for the export of SCOMET items. Applicants can receive an Advance Authorization before obtaining a SCOMET license, provided they agree to pay customs duty and interest if the SCOMET license is not granted within four months. This condition will be included in the authorization, and applicants must submit a Letter of Undertaking (LUT). This directive supersedes a previous provision from the Port Officers' Meeting minutes dated November 25, 2008, although the Export Obligation Period (EOP) provision remains applicable. Approval is from the Director General of Foreign Trade.
