Jurisdiction Clarified: Officers Can Adjudicate Seizure Cases Without Identified Manufacturer u/rs 200 & 223A, Central Excise Rules 1944.
A doubt arose concerning the jurisdiction of officers to adjudicate seizure cases when the actual manufacturer of goods cannot be identified. The Law Ministry advised that, according to Rules 200 and 223A of the Central Excise Rules 1944, the officer in whose area the goods were seized is competent to decide the case. The Board accepted this advice, and pending cases should be resolved based on this clarification.
