The Board noted inconsistencies in practices and clarified that cut-tobacco is under physical control, requiring supervision by Central Excise Officers. No overtime fees are required for clearances during normal working hours. However, for supervision between 6:00 PM and 6:00 AM on working days, or at any time on holidays and Sundays, overtime fees must be collected from the assessee as per Rule 224 of the Central Excise Rules, 1944.
