It notes observations by some High Courts and the CEGAT criticizing the Central Excise Department's coercive recovery measures during such pendency. The Board, after consulting the Law Ministry, concluded that the Department can proceed with recovery after a reasonable waiting period for the stay decision, as the pendency itself is not a legal barrier. Consequently, there is no need to revise the existing Board's Instructions from 1986. This decision should be communicated to relevant field formations.
