Central Board of Excise & Customs Halts Recovery Actions During Pending Stay Applications, Following Bombay High Court Rulings.
The Central Board of Excise & Customs issued a circular addressing the recovery of Central Excise dues during the pendency of stay petitions or applications. Despite suggestions from the trade to extend the waiting period for initiating recovery measures from three to five months, the Board did not accept this proposal. However, it acknowledged the unfairness of proceeding with recovery while stay applications were pending. The Board decided to align with the Bombay High Court's judgments, ensuring that recovery actions are paused during pending stay applications. Collectors (Appeals) are instructed to expedite the disposal of such applications.
