Modvat Credit Denied for Caustic Potash Flakes in LAB Production; Recovery of Past Credits Required by CBEC.
The circular from the Central Board of Excise & Customs addresses the issue of Modvat credit eligibility for caustic potash flakes used in manufacturing Linear Alkyl Benzene (LAB). The Board concludes that caustic potash flakes, employed to neutralize toxic hydrogen fluoride, a by-product, do not qualify for Modvat credit as they are not directly used in the LAB manufacturing process. Consequently, the practice of granting Modvat credit for caustic potash flakes should cease, and any previously granted credits should be recovered. Relevant stakeholders and field formations are to be informed accordingly.
