Telecom Operators Misusing CENVAT Credit on Non-Excisable Goods; Recovery Required This Financial Year, Report by March 15.
The circular addresses the misuse of CENVAT Credit by telecom operators who are claiming credit on goods like angles, channels, beams, and prefabricated shelters used for building transmission towers and housing equipment. These items, considered as inputs for civil structures, are not excisable goods since they are attached to the earth and not used directly for providing taxable services. The Central Board of Excise & Customs has determined that such credits are not permissible and must be recovered promptly within the current financial year. Any difficulties in recovering these credits should be reported by March 15, 2008.
