of <h1>Duty Payment on Waste Packaging: Circular Withdrawn Pending Supreme Court Appeal to Protect Revenue Interests.</h1> The circular addresses the issue of duty payment on waste packages or containers used for packaging Modvatable inputs when cleared from the manufacturer's factory availing Modvat Credit. Initially, it was clarified that duty should not be demanded, following a CEGAT order in a specific case. However, since the Department has appealed this order to the Supreme Court, the Board decided to withdraw the earlier circular, effective immediately, to protect revenue interests. A notification of this withdrawal has been communicated to all relevant officials.
