Government Enforces Rules for Compounding Customs and Excise Offences; Excludes Serious Crimes like Smuggling and Narcotics.
The Central Government has implemented the Customs and Central Excise (Compounding of Offences) Rules, 2005, effective from December 30, 2005. These rules aim to reduce litigation by allowing the compounding of offences, classified as technical or substantive. Technical offences can be compounded multiple times, while substantive offences are limited to a single compounding. Certain serious offences, including those involving narcotics, arms, or smuggling, are excluded from compounding. The Chief Commissioners are empowered to handle compounding applications, ensuring they are processed within six months. Public awareness and adherence to these guidelines are encouraged to decrease court case backlogs.
