The Board's instructions, based on prior circulars, allow a three-month period for payment of adjudicated dues before initiating recovery actions. If a stay application is rejected within this period, recovery should proceed immediately. The Bombay High Court mandates that the Commissioner (Appeal) resolves stay applications within a specified timeframe, and no coercive actions should occur during their pendency. The Board now requires the Commissioner (Appeal) to decide on stay applications within one month of filing.
