Supreme Court Verdict: Coal Ash Not Excisable, CBEC Withdraws 1998 Circular, Resolves Pending Disputes.
The Central Board of Excise and Customs (CBEC) has accepted the Supreme Court's decision regarding the excisability of coal ash in the case involving the Union of India and a power company. The Supreme Court dismissed the Department's appeal against a Gujarat High Court ruling that had set aside a previous CBEC circular classifying coal ash as an excisable commodity. Consequently, the CBEC has withdrawn its earlier circular from 1998, and all pending disputes related to this issue should be resolved in accordance with the Supreme Court's judgment. Relevant trade and field formations are to be informed of this change.
