Export Cess on Fruits and Vegetables Must Be Charged Only Once Under Relevant Acts
Export Cess on processed and primary fruits and vegetables must not be collected twice under different Acts. The Ministry of Food Processing Industries and the Ministry of Agriculture have clarified that cess cannot be charged both as a primary product under the Agricultural Produce Cess Act, 1940 and as a processed product under the Agricultural and Processed Food Products Export Cess Act, 1985. The cess should be applied only once: if the product is primary, cess is to be collected under the 1940 Act; if processed, under the 1985 Act. Customs authorities are instructed to ensure uniform compliance with this directive to avoid double charging.
