New EXIM Policy Caps DTA Sales for EOUs at 50%, Expands Export Scope for Agriculture and Services
Amendments to the EXIM Policy and related notifications for 100% Export Oriented Units (EOUs) and units in Export Processing/Free Trade Zones (EPZ/FTZ) introduce a cap on Domestic Tariff Area (DTA) sales at 50% of the previous year's FOB export value, with concessional duty rates applicable. Duty and interest may be demanded from units failing to meet export performance or proper use/re-export of duty-free inputs and capital goods within prescribed or extended timeframes, with extensions granted liberally except in cases of mala fide intent. Export scope for agriculture-related units is expanded to processed products, and services are recognized as export products for EPZ/FTZ units. EOUs/EPZ units may source duty-free goods from bonded warehouses, clear goods duty-free to specified warehouses or licensees, and export directly from registered jobworkers' premises under conditions. Importation of fuel and consumables for captive power requires Assistant Commissioner approval. Implementation difficulties are to be reported promptly.
