of <h1>Public Companies Under Part IX Must Comply with Sections 149 and 165, Per Section 578 Guidance and 1975 Circular.</h1> A public company registered under Part IX of the Act must comply with sections 149 and 165. According to sub-section (1) of section 578, all provisions of the Act apply to such companies, except for specific exceptions listed under clauses (a) to (g) of the sub-section. Consequently, the provisions of sections 149 and 165 are fully applicable to public companies registered under Part IX, as clarified by the Department in Circular No. 24/75 dated November 20, 1975.
