Analysis: The inputs had been received from SAIL's depot and the missing particulars were of a curable nature. Supporting charts correlating the inputs with master invoices were available, and the additional endorsement regarding Hero Cycles did not by itself make the invoices invalid. In the transitional period, such procedural deficiencies could not justify rejection of credit when the substantive duty-paid character of the goods was not displaced.
Conclusion: Modvat credit could not be denied on this ground and the assessee succeeded on this issue.

Analysis: The adjudication was made by an authority different from the one to whom the show cause notice was answerable, and no lawful basis was shown for the exercise of the higher powers. The decision also rested on matters going beyond the notice, which offended the requirement of proper notice and authority.
Conclusion: The proceedings were without authority of law and the assessee succeeded on this issue as well.
Final Conclusion: The denial of Modvat credit was unsustainable and the order below was set aside in full, resulting in acceptance of the appeal.
