Issues: Whether the re-railing equipment was correctly classifiable under the tariff headings proposed by the department, and whether the duty demand could be sustained without clearer evidence of the nature and working of its components.
Analysis: The equipment was described as re-railing and uprighting rolling stock and clearing track. The disputed classification turned on whether the jack component made the equipment dutiable as jacks or parts thereof, or whether the machine had an independent function warranting classification elsewhere. In the absence of clear particulars regarding all components and the manner in which they worked together, the classification could not be finally determined. The Tribunal therefore directed the Commissioner to consider the assessee's proposed expert evidence, along with any departmental evidence, and to decide the classification and consequential duty liability afresh according to law.
Conclusion: The classification dispute was not finally decided on merits and was sent back for fresh determination; the impugned orders were set aside.
Ratio Decidendi: Where the classification of excisable goods depends on the function and integration of their components, and the record is insufficient to determine the nature of the machine, the matter must be decided afresh on fuller evidence.
