Issues: Whether the product described as an energy saving combination, refrigerated closed loop fluid cooler and hot air paper dryer was correctly classified under sub-heading 8419.00, and whether it was entitled to the benefit of Notification No. 175/86-C.E. dated 1-3-1986.
Analysis: The classification had already been settled by an earlier appellate order which was not challenged. The record showed that the machine performed two functions, namely chilling water by refrigeration and heating the roll of printed paper by utilising the heat generated in the process. There was nothing on record to show that refrigeration was its basic function so as to displace the classification accepted by the lower authorities. The earlier orders in favour of the assessee had also extended the small-scale exemption.
Conclusion: The product was correctly classified under sub-heading 8419.00 and the exemption under Notification No. 175/86-C.E. remained available. The Revenue's appeal failed.
