Issues: Whether the applicant had made out a prima facie case for waiver of pre-deposit and stay of recovery in a dispute concerning classification of Rusguard products, allegations of suppression and limitation, and the demand of duty and penalty.
Analysis: The classification of the products had earlier been accepted on the basis of departmental testing and final approval of classification lists. The later reopening of the matter on the basis of fresh testing, without a satisfactory explanation, supported the applicant's contention at the stay stage. The contradictory test reports and the request for re-testing of samples also weighed in favour of the applicant. On these materials, the question of suppression and the correctness of the demand and classification was treated as a matter to be considered at the merits stage, and the applicant was found to have a prima facie case for interim relief.
Conclusion: The application for stay was allowed, and pre-deposit of the duty and equal penalty was waived with recovery stayed.
