EX., VADODARA</h3> SUNSILK DYEING & PRINTING MILLS PVT. LTD. Versus COMMISSIONER OF C. EX., VADODARA - 1999 (105) E.L.T. 56 (Tribunal) The Appellate Tribunal CEGAT, Mumbai ruled in favor of M/s. Sunsilk Dyeing & Printing Mills Pvt. Ltd. and its Director, Shri Ramprakash A. Baria, by dispensing with the pre-deposit of penalty amounting to Rs. 1.20 crores and Rs. 10.00 lacs respectively. The Tribunal considered that the duty amount had already been paid by the applicants before the adjudication proceedings concluded. The order of confiscation of plant and machinery was also put on hold during the appeal process, with a directive for the applicants not to dispose of any part of it.
