Stay/Dispensation of pre-deposit - Modvat - Declaration The Appellate Tribunal CEGAT, Mumbai heard a case where the appellant sought waiver of pre-deposit of duty of Rs. 1.31 lakhs as the input Chimasorb 944 LD was not declared in Modvat. The appellant argued that Tinuvin in the declaration is the same as Chimasorb based on a manufacturer's letter. The tribunal waived the deposit conditionally, requiring Rs. 40,000 to be kept unutilized in the account pending appeal. Compliance was ordered by May 29, 1998.
