As to wire harness, no material was shown to dislodge the finding that they fell within the restricted entry.

Conclusion: The confiscation of both items was upheld and the challenge to their importability failed.

Issue (ii): Whether the redemption fine required reduction.

Analysis: The redemption fine imposed was approximately 100% of the CIF value. Considering the circumstances and the appellants' status as actual users, some leniency was warranted in the quantum of fine.

Conclusion: The redemption fine was reduced from Rs. 1,10,000 to Rs. 75,000.

Final Conclusion: The appeal succeeded only to the limited extent of reduction in redemption fine, while the confiscation and the finding of misclassification under the import policy were maintained.

Ratio Decidendi: Where an imported article performs multiple control functions and is specifically designed as a component of air-conditioning equipment, it cannot claim Open General Licence benefit merely because one part of its mechanism answers to the description of a switch.
