Issues: Whether transistor radio sets combined with cassette recorder/player and turntable, with or without speakers, were entitled to concessional duty under Notification No. 160/77-C.E. as amended.
Analysis: The exemption notification extended concessional duty only to tape recorders, tape players, and combination sets of those articles with transistor sets. The relevant tariff entries showed that transistor sets, tape recorders, tape players, and gramophones/record players were separately identifiable goods, and the notification did not extend to every item covered by the tariff entry. A turntable or record player was neither specifically mentioned in the notification nor shown to be part of the combinations covered by it. Exemption notifications are to be construed strictly, and the scope of the notification could not be enlarged to include additional goods not specified therein. The cited precedent concerned a different notification and different goods and did not assist the appellants.
Conclusion: The goods were outside the purview of Notification No. 160/77-C.E. and were not eligible for concessional duty.
Ratio Decidendi: An exemption notification must be strictly construed, and concessional duty cannot be claimed for a product that includes an additional article not specifically covered by the notification or the combinations expressly mentioned in it.
