Versus COLLECTOR OF CENTRAL EXCISE</h3> BURN STANDARD CO. LTD. Versus COLLECTOR OF CENTRAL EXCISE - 1993 (66) E.L.T. 250 (Tribunal) The Appellate Tribunal CEGAT, Calcutta granted an interim order to M/s. Burn Standard Co. Ltd., directing the department not to take coercive measures for recovery of disputed penalty and duty until the disposal of the stay matter. The Stay Petition was adjourned due to doubts regarding the hearing of appeals by Central Government Undertakings, but it was later clarified that the pending appeals would not be affected by a Supreme Court decision. The case is scheduled for hearing on 8-4-1992.
