The plant and machinery were ordered confiscation but allowed redemption on payment of Rs. 25,000 fine. The appellants had already deposited the penalty and reversed the MODVAT Credit. The Tribunal granted a stay and waiver of recovery of the duty amount, directing the Department to lift the detention for recovery. The plant and machinery should not be disposed of until the appeal is disposed of.
