Issues: Whether the learned CIT(A) was justified in confirming the addition of Rs. 15,25,500 on account of cash deposits in the bank account, and if so, whether any part of the deposits can be accepted as explained in the facts and circumstances of the case.
Analysis: The assessee (legal heir) explained the cash deposits as arising from agricultural income, past family savings and retirement/pension funds. The Assessing Officer reopened the assessment under the provisions for escaped income after receiving AIR information of cash deposits above Rs.10 lakhs, issued notices under the reassessment provisions and added Rs.15,25,500 as unexplained money under the unexplained cash deposits provision. The Tribunal examined the source explanations, noted ownership of agricultural land and past savings, observed absence of a detailed cash flow statement but found sufficient basis to accept part of the claimed source. Having considered the material on record and the submissions placed through written representation, the Tribunal reduced the addition by crediting Rs.10,00,000 to the assessee and sustained the remainder as unexplained.
Conclusion: The appeal is partly allowed; credit of Rs.10,00,000 is given to the assessee and the addition is sustained to the extent of Rs.5,25,500 as unexplained money under the unexplained deposits provision.
Ratio Decidendi: Where partial credible explanation of cash deposits is available (such as past savings and agricultural income), a tribunal may give credit for the explained portion and sustain addition only for the unexplained balance under the unexplained deposits provision.
