Commissioner (Appeals) relied upon the decision of LSG Sky Chefs (India) (P.) Ltd. v. CST 2009 -TMI - 33134 - CESTAT BANGLORE, held that said activity will not fall under service tax activity. Held that - there is no interfere with the impugned order. The Appellate Tribunal CESTAT, Bangalore dismissed the revenue's stay petition regarding Service Tax liability on food supply to airlines. The Tribunal found no reason to stay the operation of the impugned order as the Commissioner relied on Tribunal decisions in similar cases. Application for stay was dismissed.
