(SBIIMS) - whether the penalty imposed on Appellant No.1 is proportionate to the offence and whether it meets the criteria laid down in Excel Crop Care Ltd. vs CCI [2017 (5) TMI 542 - SUPREME COURT]? - NCLAT The upheld the CCI's order, finding no merit in the appellants' arguments for reducing the penalty. HELD THAT:- It is not convincing that the impugned judgment/order passed by the National Company Law Appellate Tribunal, New Delhi, suffers from any patent illegality of warranting interference by this Court. Appeal dismissed. The Supreme Court, with Hon'ble Justices Vikram Nath and Sandeep Mehta presiding, heard the appeal and after condoning the delay, held that the impugned judgment/order of the National Company Law Appellate Tribunal, New Delhi, does not exhibit any 'patent illegality' warranting interference. Consequently, the appeal was dismissed, and all pending applications were disposed of.
