Analysis: For the remaining inputs, the duty had been paid before the cut-off date, and no rule or notification in force before 1-3-1986 authorising credit was shown. The restriction in Rule 57H(2) therefore operated against availment of credit.
Conclusion: Credit on the remaining three inputs was not allowable and the finding was in favour of Revenue.
Final Conclusion: The credit claims failed on the transitional Modvat requirements, and the order allowing credit was set aside.
