Issues: Whether the imported double drum roller dryer was classifiable under Heading 8419.39 as a dryer or under Heading 8419.81 as machinery for making hot drinks or for cooking or heating food, and whether Chapter Note 7 to Chapter 84 required classification by the principal purpose of the machine.
Analysis: The majority found that the catalogue and technical literature showed the machine to be a versatile rotary dryer used for drying a variety of products, including food items and non-food items such as glue and paints. The cooking effect, if any, was incidental to the drying function. The Explanatory Notes to Heading 8419 also supported classification of rotary dryers as dryers. Chapter Note 7 to Chapter 84, which treats a machine used for more than one purpose as having its principal purpose as its sole purpose, confirmed that the machine had to be classified by its dominant function. As the principal purpose was drying, the more specific classification was under Heading 8419.39.
Conclusion: The machine was classifiable under Heading 8419.39 and not under Heading 8419.81, and the appeal was allowed in favour of the assessee.
Dissenting Opinion: Shri I.J. Rao, Member (T), held that the machine was primarily a drying machine and not a cooking machine, and therefore also concluded that classification under Heading 8419.39 was correct. He differed only from the lower authorities and not from the result reached by the majority.
