<h1>Customs Appeal Tribunal overturns confiscation order for Acetate Filament Yarn under Customs Act</h1> <h3>JAIN SILK TRADERS, SALEM Versus COLLECTOR OF CUSTOMS, MADRAS</h3> JAIN SILK TRADERS, SALEM Versus COLLECTOR OF CUSTOMS, MADRAS - 1987 (31) E.L.T. 937 (Tribunal) The Appellate Tribunal CEGAT, MADRAS allowed the appeal under Section 129A of the Customs Act, 1962, setting aside the order of confiscation of Acetate Filament Yarn. The Tribunal found that the importer met the requirements of the Open General Licence (O.G.L.) at the time of clearance, and therefore, the confiscation order was overturned. The fine paid by the appellant will be refunded.
