Issue (i): Whether the annual letting value of the let-out property was to be taken at the rent actually received.
Analysis: The Tribunal followed its earlier view in a connected matter and accepted that, on the facts, the annual letting value of the property should be aligned with the actual rent received from the tenant. The departmental estimate of a higher annual value was not accepted.
Conclusion: The issue was decided against the Revenue and in favour of the assessee.
Issue (ii): Whether the additions for unexplained household expenses and alleged unexplained investments were sustainable.
Analysis: The Tribunal examined the cash flow charts and the related account entries and found that the assessee's family withdrawals, together with agricultural income, provided a reasonable basis for household expenditure. Once the household withdrawals were accepted, the cash flow chart was found to explain the investments and deposits, and the material relied upon by the department did not justify the additions.
Conclusion: The additions were not sustainable and were rightly deleted.
Final Conclusion: The departmental challenge failed on both counts, and the additions made in the assessment were not restored.
Ratio Decidendi: Where the assessee's cash flow and family withdrawals reasonably explain the expenditure and investments, and the higher estimated annual letting value is unsupported on the facts, the Revenue's additions cannot be sustained.
