The Departmental Representative admitted that no search warrant was issued in the name of the appellant-HUF and no communication or material was received from the AO at Calcutta by 23rd December 1996. The Tribunal found that only one notice under section 158BC was issued and served, and no material was received from the AO at Calcutta by that date, rendering the notice invalid.
