Issues: Whether the imported Radio Terminals were classifiable as BTS ancillary equipment and entitled to exemption under Notification No. 11/97-Cus.
Analysis: The imported equipment was found to be necessary for interconnectivity within the cellular network, linking BTS, BSC and MSC units. The technical material showed that the Radio Terminals transported digital speech and control information and that, without them, the cellular telephony system could not function effectively. On that functional basis, the equipment was treated as ancillary to the BTS rather than as a mere part of the overall network.
Conclusion: The imported Radio Terminals qualified as BTS ancillary equipment and were entitled to the benefit of the exemption notification.
