The High Court of Judicature at Bombay set aside the Order-in-Appeal that rejected an appeal due to non-deposit of 10% penalty. The petitioners have since deposited the required amount, leading to the appeal being restored for further consideration by the Director General of Foreign Trade. Petition disposed of accordingly.
