Issues: Whether the appellant-school should be granted further time to vacate and deliver possession of the five-acre school property to the title holder.
Analysis: The first respondent acquired title to the larger property through a registered conveyance pursuant to the Supreme Court's directions. The earlier order had permitted the appellant to continue running the school only until the end of the academic year after the respondent obtained title. That period had expired, and the request for twenty-five years' further occupation was not accepted. Having regard to the ongoing academic session, a limited extension was considered appropriate.
Conclusion: The appellant must hand over vacant possession by 31 May 2022, upon furnishing an undertaking within four weeks; until then, the school may operate without interference. The issue is partly in favour of the appellant.
