Evasion of service of this Notice under Order XXI Rule 22 of the Code of Civil Procedure 1908 - HELD THAT:- The present Notice is made absolute. A print-out of the WhatApp message is taken on record and marked “N” for identification with today’s date. The second print out is of the WhatsApp contact number of the Respondent. This shows his contact number. This is also taken on record and marked “N2” for identification with today’s date. This is sufficient for the purposes of service of Notice under Order XXI Rule 22. Respondent was evading service of the Notice under Order XXI Rule 22 of the Code of Civil Procedure, 1908. Service by an authorized officer of the Claimant via a WhatsApp PDF and message to the Respondent's mobile number was accepted for the purposes of service because the 'icon indicators' showed both delivery and that the message and attachment were opened. The Claimant will furnish particulars of the Respondent's rented residence in Nalasopara so that a warrant may be issued if necessary. The Notice is made absolute. A print-out of the WhatsApp message is taken on record and marked 'N' and a print-out of the WhatsApp contact number, showing the Respondent's number, is taken on record and marked 'N2'. A scan of the print-outs is attached to the order so they remain part of the record.
