Maintainability of appeal before the Tribunal - HELD THAT:- Considering the fact that proceedings has been initiated against the appellant under Insolvency and Bankruptcy Code 2016 (IBC) and resolution plan has already been approved, in that circumstances it is held that the appeals are not maintainable before the Tribunal. Accordingly, the same are dismissed. The appeals were dismissed by the Appellate Tribunal CESTAT Kolkata as proceedings were initiated against the appellant under the Insolvency and Bankruptcy Code 2016 and a resolution plan was approved. Both sides were in appeal against the impugned order. The appeals were held not maintainable.
