Issues: Whether the use of another company's logo on the cartons of the specified goods disentitled the manufacturer from exemption under Notification No. 175/86-C.E. by attracting paragraph 7 read with Explanation VIII.
Analysis: Paragraph 7 denies exemption where the manufacturer affixes the goods with the brand name or trade name of another person who is not eligible for the notification. Explanation VIII makes the test one of use of a name or mark in relation to the goods for indicating a connection in the course of trade with that person.
